
VELMA, Okla. – New developments tonight in yesterday's stabbing death in Velma. Authorities say Bryan Miller of Duncan was stabbed to death by Bobby Joe Dyer in Dyer's home, but that Dyer will not be charged in his killing.
The Stephens County Sheriff's Department says Miller forced his way into Dyer's home and started fighting with him. They say Dyer grabbed a knife and began stabbing Miller, and even accidentally stabbing himself. Miller was rushed to the hospital where was pronounced dead.
To clarify, there is no relation between Bobby Joe Dyer and Charles Dyer.
As far as this case is concerned, Sheriff Wayne McKinney says Dyer and Miller had a history of not getting along for the past several months. They say Miller started their last fight. But while Dyer will not be held responsible for his death, they did find evidence of another possible crime.
McKinney says authorities quickly determined that Miller was responsible for starting the violent fight with Dyer that ended tragically.
"Mr. Dyer had a chance to protect himself, which he has the right to do, and stabbed Mr. Miller, killing him," said McKinney.
But after determining it was a case of self-defense, McKinney says it became clear that something else was not right. There were three children in the home during the attack.
"We interviewed the children. We brought them to the sheriff's department and our investigators sat down with them. And when he sat down with him he noticed that one of the children had a black eye and some obvious injuries, some old healing injuries and some that are pretty recent ones," said McKinney.
Officials immediately notified DHS and sent a case worker over to interview the children along with investigators. That is when they determined there had been a history of physical child abuse.
"There's zero tolerance. It has nothing to do with the stabbing that occurred at the home. It has to do with a separate crime committed on small children that will not be tolerated."
Dyer will be charged with physical child abuse. Investigators also found marijuana in the house, so he will also face a possession charge. Dyer is currently in the county jail, while the affidavit is being prepared for his arraignment.
Tonight the children are in protective custody. McKinney says he believes the abuse had been going on for a long time and the investigation will continue.
