No charges filed in death during October police pursuit

LAWTON, Okla_New information has been released in the death of a man who was killed by an officer's car during a police pursuit in Lawton last month.

The Comanche County District Attorney's office has decided not to file criminal charges against the officer in the case. 

District Attorney Fred Smith sent a letter to Lawton police Chief James Smith last week giving his decision. The letter says the D.A. reviewed reports from the OSBI and the highway patrol and determined Sergeant Richard Harter's actions that night did not warrant filing criminal charges.

Michael Davis died after a chase that started with a domestic assault call at a Lawton motel and ended when Davis was hit by the officer's car in a residential area several miles away.

We have been unable to get a response from the OSBI on the case, so the specific details of the accident are still unknown. But, we will continue to push for the release of that information. 

The letter also said Harter is free to return to duty at the department's discretion.
