
Lawton, Okla._A man convicted of a double murder in 1994 is asking to be released from prison.
David Flowers was sentenced to two life terms for the killings. He was 16 at the time, but was tried as an adult. His attorney filed an appeal last week, saying the court failed to arraign him in a timely manner. He says that delay means the court lost jurisdiction to try him as an adult.
Flowers and two other men were convicted of shooting and killing 39-year-old Juan Franceschi and his 15-year-old son Lonnie. The men had stormed into the family's house in a botched attempt to take the keys to the family's car. Bryan Toles was identified as the actual triggerman. He was also convicted, and was executed in 2003.
No word on when the judge is expected to rule on Flowers' request.
