Hobby Lobby Allowed to Proceed in Birth Control Case

OKLAHOMA CITY Okla_ Hobby Lobby stores have won a small battle in their fight against federal birth-control coverage mandates.

The 10th Circuit Court of Appeals in Denver ruled Thursday that the Oklahoma-City based company can move forward with its case and won't be subject to millions of dollars in fines as the case proceeds.

The court reasoned that Hobby Lobby had "established a likelihood of success that their rights under this statute are substantially burdened by the contraceptive-coverage requirement."

The case has been remanded back to district court, which will rule on whether or not to grant an injunction against the requirement.
