CLOVIS - An accused Clovis child killer could finally head to trial soon ending the eight year long saga.

District Judge Drew Tatum said earlier this month a trial date could be set once Noe Torres had a new attorney, and as of Friday, he does. Once his trial is over, this case could finally be closed.

It was on September 15, 2005 that 10-year-old Carlos Perez was shot in the head while asleep in the bedroom he shared with his 17-year old brother.

Police say his older brother was the intended target.

In the days, weeks and months following the crime, a total of five people were charged in connection to the child's death.

But in the end, it was Edward Salas and Noe Torres charged with first degree murder.

Salas was sentenced to life in prison plus 56 years in 2008, but escaped from the Curry County Jail the night before he was to start serving that sentence in the state penitentiary.

He was arrested again in Mexico, in October of last year after becoming a famous fugitive on the U.S. Marshal's most wanted list.

Torres still has yet to face trial.

He fled Clovis after the 2005 murder taunting authorities for years even making phone calls to America's Most Wanted list and the Curry County district attorney.

It was a letter he wrote to New Mexico Governor Susana Martinez last January that finally led to his arrest in Mexico.

Torres' trial date has been rescheduled several times; the latest because he said his former attorney had a conflict of interest in the case.

Torres' new lawyer is Stacey Ward. An official trial date has not yet been announced.
