Toxicology report released in "TEXAS" crash

Amarillo, TX - New information has been released in the ongoing investigation of the wreck that killed five "TEXAS" cast members last month.

The Texas Department of Public Safety just released a toxicology report that indicates the driver was under the influence when he pulled out in front of an oncoming truck.

According to the report, 20 year-old Clinton Diaz had a blood-alcohol level of 0.165, which is twice the legal limit of 0.08.  The blood test also showed marijuana to be present in his system.

On August 12th, Diaz ran a stop sign on Highway 287 just north of Dumas after a cast party, and the vehicle was struck by an oncoming truck.  Diaz and four passengers were killed in the collision.

Those victims were: Andrew Duncan, 20, Amanda Starz, 20, Julian Arredondo IV, 24, and Eric Harrison, 21.

Passenger Timothy Johnson, 30, was seriously injured in the wreck, but his condition has greatly improved since then.

The driver of the truck was admitted to the hospital, but has since been released.

The report showed the truck driver was not impaired at the time of the accident.

The Texas Alcoholic Beverage Commission has been investigating the case, and a call to the Amarillo office this afternoon (Sept. 4) was not returned.
