Okla. Attorney Questions New DUI Laws

Posted: Updated:

OKLAHOMA CITY Okla_ Some Oklahoma drivers and defense attorneys are questioning new DUI laws set to take effect next Tuesday.

It says drivers with any amount of schedule one prescription or illegal drugs in their system will be considered under the influence. This means drivers will be considered impaired even if the drug was used several days prior, but still shows up in blood, saliva or urine samples.

"The DUI laws are there to protect the public," Attorney Clayton Hasbrook said. "If the drivers aren't actually impaired, then it's not actually doing anything to protect the public."

Remember, it's not just illegal drugs. Hasbrook warned that those who take prescription medication should be extra careful, because traces of the substance could also be detected even days later.
