Law struck down banning sexually explicit online communication with minors

Amarillo, TX - A law banning sexually explicit Internet communication between an adult and a minor has been struck down by the Texas Court of Criminal Appeals.

According to the ruling, the 2005 law was written to prevent anyone from using the Internet or electronic messages, including texts, to "lure" children into sexual situations.

Judge Cathy Cochran, who made the ruling, says because the law was written so broadly, it violates The First Amendment.

Because the law was written so generally ... violations could include sending messages about books, television shows, or movies.

The ruling did note online solicitation and other inappropriate behavior with children is already outlawed by other statutes.
