LAWTON, Okla._ The charges against a hit-and-run suspect have been upgraded to manslaughter.

Bryan Blackaby was arrested at his home at northwest 26th Street and Gore Boulevard on Tuesday after spending a week in hiding. Blackaby was originally charged with leaving the scene of a fatality accident; now he’s being charged with manslaughter in addition to leaving the scene of an accident.

Court documents revealed Wednesday, police believe Blackaby was driving under the influence of alcohol when he hit Troy Magee along 52nd and Cache Road killing him.

The day after the accident, one of Blackaby's friends told police he was following Blackaby home from a bar when he saw him swerve but didn't know why. The day after the accident the witness said Blackaby brought his truck to his body shop, where he worked, to get it fixed. The truck was bloody and had what appeared to be human hair was stuck in the windshield.

He told his friend he saw the accident on the news and recommended Blackaby turn himself in. Blackaby said he was just hoping it would all just go away.

Blackaby's wife was also formally charged on Wednesday with harboring a fugitive. Police went to the couple’s house one day before his arrest and his wife, Rebecca, told investigators she hadn't seen her husband since the previous Wednesday. When police returned with a search warrant, she admitted he was inside and said she lied because she knew he was in trouble and was scared.

Her bond was set at $2,500.
