LAWTON, Okla._The Oklahoma Court of Criminal Appeals has upheld the conviction of a Lawton man who was sentenced to 25 years in prison for second-degree murder.
Jimmy Nazario Jr. was found guilty last year in the shooting death of Ervin Manigault. The two men had a confrontation over graffiti at an apartment complex in west Lawton. Nazario said he acted in self-defense, but the jury disagreed, in part, due to evidence showing Manigault was shot twice in the back.
Nazario's appeal claimed there was an error in jury instructions, improper testimony and misconduct by the prosecutors, as well as ineffective counsel defending him.
