OKLAHOMA CITY, Okla._The Oklahoma Court of Criminal Appeals is getting set to hear arguments Tuesday over a Comanche County man's death penalty case.
Mica Martinez was convicted June 2013 for the 2009 murders of Carl and Martha Miller near Cache. He beat the husband to death with a rifle and sexually assaulted his wife before she was beaten to death. Investigators say he then got into a bloody fight with their adult son. Jurors recommended Martinez be put to death for the crimes.
His defense attorneys want the appeals court to reduce his sentence to life in prison because he suffered from severe depression. They originally argued his judgment was clouded by alcohol.
