COMANCHE COUNTY, OK (KSWO) - A man on death row for killing a couple in their home in Cache lost his appeal for a new trial, or a reduced conviction Tuesday.
Mica Martinez argued his appeal should be granted because his attorney changed strategy in the middle of the trial, and was generally ineffective. But, the state court of criminal appeals rejected those arguments. Martinez was convicted in the October 2009 beating deaths of Carl and Martha Miller, and sentenced to death in 2013. His attorney had no comment on the court's ruling.
