2 votes made in error to likely prompt new election in Terry County

TERRY COUNTY, TX (KCBD) -

Tuesday's election in Terry County ended with no clear winner in the race for Precinct 4 County Commissioner and a likely lawsuit.

According to the Brownfield News, two hours after the polls closed the Terry County Elections Administrator informed the four candidates in that race there was a problem with the votes.

Ernest Elizardo received 131 votes, not enough to avoid a runoff. Aaron Thompson earned 64 votes. Howard Moorhead earned 63 votes. Marvin Dawson received 63 votes.

However, two votes were cast at the American Legion in this race by voters who don't live in Precinct 4.

Terry County Republican Chairman Brad Moore told the Brownfield News that the Election Day voters were most likely handed the wrong ballot and voted without noticing the error.

“That’s the only discrepancy in this whole dadgum election and it happened in this precinct,” Moore said in an interview with the Brownfield News.

Moore said he expects to file a lawsuit in district court on behalf of the candidates, who have all agreed to the suit, complaining the election wasn't fair and contesting the results.

If the election is declared invalid, according to Moore, all four candidates would most likely be required to run again. 

The Brownfield News reports the Commissioners Court must first certify the election results 10 days following Tuesday's election before any action can be taken.

That new election is expected to cost the county around $3,000 to $5,000.
